DISTANCE SELLING DIRECTIVE (2000)

In accordance with the Distance Selling Directive (2000), non-perishable goods cannot be cancelled after dispatch but can be cancelled before 12 noon on day of dispatch. This exemption does not affect your statutory rights as a consumer in the UK. Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

REACHING US

If you need to contact us please call us on 0845 600 8417 between the hours of 9.00am to 5.00pm Monday to Friday excluding bank holidays or by email on fruitbaskets@mackservice.co.uk. Our target response for emails will be 48 hours upon receipt within working hours but may be longer over busy periods such as Christmas, Valentine's and Mothers' Day.

ORDERING AND DELIVERY

Orders will be dispatched for next day delivery if received by 12 noon Monday to Thursday to most UK mainland addresses. Orders taken on a Friday, Saturday or Sunday will be delivered the next Tuesday. In the case of the Monday being a Bank Holiday the order will be processed on the Tuesday for delivery on Wednesday. Any changes to these delivery schedules will be notified on this page. Deliveries to Northern Ireland and certain Scottish addresses will usually take 2 working days. We regret that at present we are unable to deliver to the Channel Islands and the Isle of Man.

DELIVERY CHARGE

A delivery charge of £5.00 per basket is levied on all orders. Additions of soft toys will be included in the baskets and will therefore be included in the £5.00 delivery charge. Costs associated with packaging, handling, and gift cards are contained within the price of each individual gift product shown. We can include a personal message with each basket ordered on individual greetings cards (these are standard cards). Please decide upon your message before placing your order as we cannot guarantee being able to change these after receipt of order.

GENERAL DELIVERY

It is the customer's responsibility to ensure all delivery address/details for the recipient are given correctly. Fruit-baskets.co.uk cannot accept any responsibility for costs for non delivery to the intended recipient or losses in such circumstances. Whilst we would try to rectify such situations as best as possible, fruit-baskets.co.uk will not issue refunds in such circumstances. Fruit-baskets.co.uk use a third party courier who require a signature on receipt for proof of delivery. We cannot give a time of delivery other than to say it will be between 9.00am and 5.00pm on day of delivery. It is the responsibility of the person placing the order to ensure the recipient will be there to receive the gift. In the case of non-delivery our courier will leave a card to ask the recipient to call to rearrange delivery. It is the responsibility of the recipient to arrange this redelivery and ensure that they will be there to receive it. If there is no one there to receive the gift on that occasion, our courier will return to depot for disposal. Any redirection costs incurred will be charged. For orders where a third party will accept and sign for the delivery on the recipients behalf, i.e. a hospital, airport, college, university or workplace etc, the signature of the person authorised to accept a delivery on behalf of the organisation shall be accepted as proof of delivery. Fruit-baskets.co.uk suggests that the sender takes the time to inform any such third party to expect their delivery prior to placing an order to ensure there is no delay in the recipient receiving their gift. Fruit-baskets.co.uk will not deliver to PO Box addresses. Once an order has been received and your payment details confirmed you will be sent an email to confirm receipt of your order. All prices advertised include VAT at the current rate of 17.5% where applicable.

NUT POLICY

Due to the nature of shipping and storage we cannot guarantee that our products have not come into contact with any nuts. Therefore we cannot guarantee our products are free from nuts or nut traces.

SUBSTITUTIONS

We reserve the right to substitute with goods of minor variations, of an equal or higher value in all out gift baskets. The use of all fruits is limited to availability and quality on a particular day.

LIABILITY

The company shall have no liability for indirect or consequential loss, damage, injury or expense including loss of profit, however, arising except in respect of personal injury occasioned by the Company's negligence. By pressing the "Make the order" button the customer is accepting to abide by our terms and conditions in full.
